Before you lodge your complaint

Where does my complaint go once it is submitted?

Your complaint goes directly to Emverio Workplace Complaints . We are an independent private complaints scheme which provides safe and robust reporting processes for workplaces. If the workplace that you are complaining about is not a member, as a courtesy we will notify the workplace of your complaint. However, we have no power to compel them to take any action unless they are a member and have authorised us to do so.

How do I know if the workplace I am complaining about is a member?

Emverio Workplace Complaints will be referred to in the workplace's policies. If you are unsure you could ask HR or someone in the management team.  Sometimes policies are on websites and can usually be requested or found on internal intranet systems.

What happens after I lodge a complaint?

Emverio Workplace Complaints will review your complaint and:

  • if you do consent to disclose the information to the workplace, we will do that within 24 hours of recieving your complaint. 

  • if you do not consent to disclose the information  we cannot take any further action (anonymous or not). However, you can still report your complaint to us. Reporting can be a good way to capture trends.  Although we will not contact or report your complaint to the workplace without your consent, we can report on trends generally accross industries and your information will be used to identify and capture those trends.  

You may also want to explore reporting your complaint to a government body such as the Fair Work Ombudsman or your local Workplace Health and Safety Office.

Can Emverio accept Whistleblowing Complaints or Public Interest Disclosures (PID's)?

Emverio can only accept whistleblower complaints or PID's if your workplace has authorised us to.  If we are named in your policy we will be referred to as an ' eligible recipient' or PID Coordinator.  For whistleblower and PID's it is important to complain to the right person.  Because, if you want to attract whistleblower protections you must follow the reporting guidelines outlined by the ASIC or State Authority which should be outlined in the workplace policy.  You may forfeit your protections if you don't follow propoer reporting rules. 

Can I become a member?

Workplaces can become members and we would be happy to invite the workplace to join our scheme.  Please email us on info@complaints.emverio.com and one of our friendly representatives will be in touch to discuss how we can be an integral part of building a robust reporting framework.  Individuals cannot become members.

Is this form safe?

Yes. All data collected through this platform is securely stored within Australia.  The platform follows the Australian Privacy Principles and ACSC Cyber Security principles among others. More information on its' security and privacy can be found here: https://snapforms.com.au/security/

If you choose to be anonymous (tick yes) you must make sure that you do not provide any information that will reveal your identity in the following questions. Unfortunately Emverio Workplace Complaints cannot take any further action if we do not have your consent to report your complaint to the workplace complained about. However, y ou can still lodge the details of your complaint.  Return to the previous page and check 'Report to Emverio only'.  Although we will not take any further action, reporting can assist to identify general trends accross industries.

Whistleblowing

Whistleblowing and Public Interest Disclosures

You have advised that you think you may be a whistleblower or the complaint is a PID  or that you don't know whether you may be a whistleblower / PID. 

A whistleblower is someone with a special type of complaint that is treated differently to the way other workplace greivances are managed.  A PID may be relevant if you are complaining about a government organisation.

Companies are required to investigate them differently to protect whistleblower / PID identities and if you are deemed a whistleblower / PID there are legal protections available to protect you from detriment, such as;

  • harassment or intimidation

  • harm or injury, including causing them psychological harm

  • damage to property

  • damage to reputation

  • damage to business or financial position

  • cause any other damage.

If you want to attract the whistleblower / PID protections you must meet certain criteria about;

  • what you're reporting, and

  • who you're reporting to ( an eligible recipient)

Emverio can only recieve a whistleblowing or PID complaints from a workplace that has authorised us to recieve its' complaints. 

To find out whether Emverio is authorised to reiceve a whistleblowing or PID complaint on behalf of the workplace that you are complaining about  please check the workplace's whistleblowing / PID policy.

Who is an 'eligible recipient'? Generally you can report your concerns internally to an officer, senior manager or a person the company or organisation has authorised to receive whistleblower reports. Generally, an 'officer' includes a director or company secretary of a company or organisation. Workplaces can appoint Emverio as an 'eligible recipient'.

Emverio cannot recieve whistleblowing complaints or PID's unless we are named by the workplace (via their policies) as an eligible recipient.  Please consult the workplace's policy to find out who you should disclose your complaint to.  If you are still unsure please contact Australian Securities & Investments Commission (ASIC) or your Ombudsmans' office if you work for government.
